These Terms of Service ("Terms") are an agreement between you and Hishabiz ("Hishabiz", "we", "us") for your use of the business management software and website at hishabiz.com (the "Service"). By creating an account or using the Service you agree to these Terms and to our Privacy Policy. If you use the Service for a business, you confirm you have authority to bind that business.

1. Accounts and eligibility
- You must be at least 18 years old and able to enter a binding contract to register a business account.
- You must provide accurate, current and complete information, including your name, email address, mobile number, business name and business type, and keep it up to date.
- Each registration creates one business workspace with you as its owner. You may invite employees, subject to your plan's limits. You are responsible for their activity under your business.
- One mobile number can be used for only one business registration, and one email address for only one user account.
2. Sign-in methods and security
- You can sign in with your mobile number or email and password, or, if you choose, with Google ("Continue with Google").
- If you use Google, you authorise us to receive your name, email address and Google account identifier as described in the Privacy Policy. Your use of Google is also subject to Google's own terms.
- If an account already exists for your Google email, you will be asked to confirm that account's password before the two are linked.
- You are responsible for keeping your password and your Google account secure, and for all activity under your account. Notify us promptly at the contact address below if you suspect unauthorised use.
3. The Service and availability
Hishabiz provides tools for small and medium businesses such as sales, purchases, stock and inventory, customers and suppliers, dues, expenses, invoices and reports. Available features depend on your plan.
We work to keep the Service available, but we do not promise it will be uninterrupted, error-free or always available. Maintenance, updates, third-party outages or events beyond our control may cause interruptions. We may add, change or remove features, with reasonable notice where practicable.
4. Plans, trial and billing
- Free plan. New businesses are placed on the free plan, which has usage limits (for example, on the number of products and on monthly sales and purchase entries) and excludes some features.
- Paid plans. We offer paid plans (currently shown as Basic, Professional and Business) with higher limits and additional features, at the prices and with the limits published on our website at the time you subscribe.
- Launch trial. We may offer a free trial or launch period in which some limits are lifted. Its length and end date are as published or communicated by us and may be changed for future users. When a trial ends, your business moves to the plan that applies to it, and plan limits and feature restrictions then apply. Existing data is not deleted solely because a limit is reached, but you may be unable to add more records or use restricted features until you reduce usage or upgrade.
- Payment, renewals and cancellation. The Service does not currently process payments inside the application. Payment methods, billing periods, renewals and cancellation for paid plans are arranged with us directly using the contact details below, and the terms confirmed to you when you subscribe apply. You may stop using a paid plan at any time by contacting us; unless we state otherwise in writing, amounts already paid for a billing period are not refundable.
- We may change plan prices and limits for future billing periods and will give reasonable advance notice to paying customers.
5. Your business data
- You own the business records and other content you enter ("Your Data"). You give us a limited licence to host, process, display and back up Your Data only as needed to provide and support the Service, as described in the Privacy Policy.
- You are solely responsible for the accuracy, completeness and legality of Your Data and for the decisions you make using it.
- You are responsible for having the right to record personal information about your customers, suppliers and employees, and for complying with laws that apply to your business, including tax, record-keeping and consumer laws.
- We do not review Your Data for correctness. Reports and totals reflect what you and your users entered.
6. No professional advice
Hishabiz is a record-keeping and management tool. It does not provide accounting, tax, legal, audit or financial advice, and its outputs (such as reports, invoices and profit figures) are not a substitute for a qualified professional. You are responsible for your own tax filings, statutory records and compliance.
7. Acceptable use
You must not:
- use the Service for anything unlawful, fraudulent or misleading, including recording fictitious transactions to deceive others;
- access or try to access another business's data, or bypass the Service's security or tenant separation;
- probe, scan or test the Service for vulnerabilities without our written permission;
- interfere with or overload the Service, or introduce malware;
- use automated means (bots, scrapers) to extract data from the Service, other than features we provide;
- share your account in a way that breaks your plan's limits, or resell or sublicense the Service without our written consent;
- upload content that infringes others' rights or that is unlawful or abusive;
- copy, reverse-engineer or create derivative works of the Service, except as the law allows.
8. Suspension and termination
- You may stop using the Service at any time. To close your account and request deletion of your data, contact us (see the Privacy Policy for how requests are handled).
- We may suspend or terminate access, with notice where reasonable, if you breach these Terms, create risk or legal exposure for us or other users, fail to pay amounts due on a paid plan, or if we are required to by law. We may also discontinue the Service, giving reasonable notice.
- On termination your right to use the Service ends. Provisions that by their nature should continue (such as intellectual property, disclaimers, limitation of liability and governing law) will survive.
9. Backups and data availability
We take reasonable steps to protect Your Data, but we do not guarantee that data will never be lost, corrupted or unavailable, and we do not currently promise a particular backup frequency or recovery time. You are responsible for keeping your own copies of records that are important to your business or that you are legally required to keep.
10. Intellectual property
The Service, including its software, design, text, logos and the Hishabiz name, belongs to us or our licensors and is protected by law. We grant you a limited, non-exclusive, non-transferable, revocable right to use the Service for your internal business purposes while these Terms apply. This does not give you ownership of the Service or the right to use our name or logo without permission. If you send us feedback or suggestions, we may use them without obligation to you.
11. Disclaimers and limitation of liability
- The Service is provided "as is" and "as available". To the fullest extent permitted by law, we disclaim all warranties, express or implied, including fitness for a particular purpose and non-infringement.
- To the fullest extent permitted by law, Hishabiz will not be liable for indirect, incidental, special, consequential or punitive damages, or for loss of profits, revenue, goodwill or data, arising from your use of or inability to use the Service.
- To the fullest extent permitted by law, our total liability for any claim relating to the Service is limited to the amount you paid us for the Service in the three months before the event giving rise to the claim (or BDT 1,000 if you were on the free plan).
- Nothing in these Terms excludes liability that cannot be excluded under applicable law.
- You agree to indemnify us against claims arising from Your Data or your breach of these Terms, to the extent permitted by law.
12. Changes
We may update these Terms. The "Last updated" date shows the current version. For material changes we will take reasonable steps to notify you, for example by email or an in-app notice. If you keep using the Service after the change takes effect, you accept the updated Terms. If you do not agree, you should stop using the Service.
13. Governing law
These Terms are governed by the laws of the People's Republic of Bangladesh. Disputes will be subject to the jurisdiction of the competent courts of Bangladesh. We encourage you to contact us first so we can try to resolve any issue informally.
